Terms & Conditions.
These Terms explain how you may use the Eat My Pixel website, purchase creative services and interact with independent businesses featured through the Business Hub.
Booking another business through the Hub?
Unless a booking page expressly says that Eat My Pixel is supplying the service, the independent business named on the listing or booking is the service provider and your service contract is with that provider—not Eat My Pixel.
About these Terms
These Terms and Conditions apply to your use of the website eatmypixel.co.uk and to services provided directly by Eat My Pixel.
The website is operated by [YOUR FULL PERSONAL LEGAL NAME], trading as Eat My Pixel , a sole trader based in Newquay, Cornwall, United Kingdom.
Our correspondence address is: [YOUR BUSINESS CORRESPONDENCE ADDRESS] . This is a correspondence address and is not a public-access office. Meetings are available only when arranged and confirmed in advance.
You can contact Eat My Pixel at hello@eatmypixel.co.uk .
By using this website, submitting an enquiry, accepting a quotation or placing a booking, you agree to the parts of these Terms that apply to you.
Nothing in these Terms removes or restricts any rights you have under UK consumer law.
Using the website
You may use this website for lawful personal or business purposes and to learn about Eat My Pixel, its creative services and independent businesses featured in the Business Hub.
You must not:
- use the website for unlawful, fraudulent or misleading purposes;
- attempt to gain unauthorised access to the website, its hosting, accounts or connected systems;
- knowingly introduce viruses, malicious code or other harmful material;
- scrape, reproduce or commercially exploit website content without permission;
- submit false, abusive, defamatory or deliberately misleading information;
- impersonate another person or business.
We may restrict or block access where we reasonably believe the website is being misused.
Creative services
Eat My Pixel provides services that may include website design, website support, social media management, photography, content creation, branding, graphics, print design, marketing support and related creative work.
The exact services, deliverables, timescales and fees will be set out in a quotation, proposal, email, invoice or other written agreement.
A project begins only when:
- the scope and price have been accepted;
- any requested deposit or initial payment has been received; and
- the information, content and access reasonably needed to begin have been supplied.
If there is a conflict between these website Terms and a project-specific written agreement, the project-specific agreement will apply to that project.
Quotes and prices
Quotations are based on the information available when they are prepared. Unless stated otherwise, a quotation remains valid for 30 days.
Prices will state whether VAT applies. Any third-party costs—including hosting, domain names, premium software, stock assets, printing, advertising spend, travel or platform charges—will be identified where reasonably possible.
Work outside the agreed scope may require a revised quotation or an additional fee. We will normally discuss material extra costs before undertaking the additional work.
Obvious pricing or typographical errors do not bind Eat My Pixel. If an error is discovered, we will contact you and give you the choice of accepting the corrected price or cancelling the affected order.
Payments
Payment dates and instalments will be shown on the relevant quotation, invoice or written agreement. Unless agreed otherwise, invoices must be paid by the due date displayed on the invoice.
Deposits reserve project time and allow work to begin. Whether a deposit is refundable will depend on the work already completed, costs already incurred, the timing of cancellation and your statutory rights.
Where an invoice remains overdue, Eat My Pixel may:
- pause work or withhold unfinished deliverables;
- postpone future scheduled work;
- suspend ongoing support after giving reasonable notice; and
- pursue payment using lawful recovery methods.
Eat My Pixel will not deliberately remove or interfere with a live client website in a way that would be unlawful or disproportionate.
Your responsibilities
To allow us to provide creative services, you agree to supply accurate information, content, instructions, decisions, feedback and access within a reasonable time.
You are responsible for checking:
- names, prices, dates, claims and factual information;
- spelling and final copy;
- that you have permission to use all photographs, logos, music, fonts, testimonials and other materials you provide;
- that your products, services, promotions and advertising comply with the laws and rules applying to your business;
- final proofs before printing, publishing or launch.
Eat My Pixel is not responsible for a delay caused by missing content, delayed approvals, inaccurate information or unavailable account access.
Revisions and changes
The number of revisions included in a project will be stated in the quotation or project agreement. If no number is stated, reasonable amendments that remain within the original agreed scope will be considered.
A substantial change of direction, repeated changes to previously approved work, new pages, additional content, additional photography or new features may be treated as additional work.
We will let you know where a request is likely to change the price or delivery date.
Timescales and delivery
Any estimated delivery date is based on the project information and availability known at the time. Unless expressly agreed as a fixed deadline, project dates are estimates rather than guarantees.
Timescales may change because of:
- delayed content, feedback or approval;
- changes to the original project scope;
- technical problems involving hosting, domains, platforms or third parties;
- illness, emergencies or events outside reasonable control.
We will communicate significant delays and provide a revised estimate where reasonably possible.
Cancellations and rescheduling
To cancel or postpone an Eat My Pixel project, contact hello@eatmypixel.co.uk as soon as possible.
If a project is cancelled after work has begun, you may be charged for work already completed and non-refundable costs already committed. Any remaining balance or refund will be calculated fairly, taking account of the circumstances and your statutory rights.
Consumers may have legal cancellation rights for contracts agreed at a distance. The existence and extent of those rights depend on the service, whether work has started at the customer’s request and whether the work is personalised.
We will not restrict a cancellation or refund right that the law gives you.
Cancellations for Business Hub providers are handled under the provider’s cancellation policy. See Sections 11–13 below.
Intellectual property
All intellectual property owned by Eat My Pixel before a project begins remains the property of Eat My Pixel. This includes working methods, templates, systems, reusable code, concepts and know-how.
Unless agreed otherwise, ownership or the agreed licence for final bespoke work passes to the client only after all invoices relating to that work have been paid in full.
Drafts, rejected concepts and unused alternatives remain the property of Eat My Pixel unless purchased under a separate written agreement.
Third-party materials—including fonts, plugins, themes, software, stock assets and music—remain subject to their own licence terms.
Unless confidentiality has been agreed, Eat My Pixel may display completed, publicly released work in its portfolio, website and social media. Please tell us before work begins if confidentiality is required.
Website visitors must not reproduce, modify, sell or commercially exploit Eat My Pixel website content without prior written permission.
The Business Hub
The Business Hub promotes and introduces visitors to independent businesses, venues, practitioners, brands and service providers.
Unless expressly stated otherwise, Eat My Pixel acts as a directory, marketing platform, introducer or booking facilitator. Eat My Pixel is not the business delivering the third-party service.
The independent business identified on the listing, booking page or confirmation is responsible for:
- providing and delivering its service;
- the accuracy of its service information, prices and availability;
- maintaining appropriate qualifications, registrations, licences and insurance;
- health and safety, safeguarding, hygiene and risk assessments;
- deciding whether a service is suitable for a particular customer;
- accessibility arrangements;
- customer care and professional conduct;
- cancellations, rescheduling, refunds and complaints relating to its service.
Being featured on the Business Hub does not create an employment, partnership, joint venture or agency relationship between Eat My Pixel and the provider, except where a specific written agreement expressly says otherwise.
Bookings with Hub providers
A Hub listing may allow you to:
- visit the provider’s own website;
- contact the provider directly;
- submit a booking request through Eat My Pixel; or
- use a third-party booking platform.
Unless a booking page clearly identifies Eat My Pixel as the service provider, your contract for the booked service is with the independent provider named in the listing or booking confirmation.
Submitting a booking request does not guarantee acceptance. A booking becomes confirmed when the provider or its booking system issues confirmation.
You are responsible for checking:
- the provider’s identity and contact information;
- the date, time, location and price;
- the provider’s cancellation and refund policy;
- any medical, safety, age, access or eligibility requirements;
- any instructions supplied before attending.
If you have a medical condition, injury, allergy, pregnancy, accessibility need or other concern relevant to a service, you should discuss it directly with the provider before booking or attending.
Provider payments, cancellations and refunds
The booking page or confirmation should identify who receives payment and which cancellation policy applies.
Where payment is made directly to an independent provider, Eat My Pixel does not hold those funds and cannot issue a refund on the provider’s behalf.
Where a payment facility is made available through this website, the checkout or confirmation will state whether payment is being collected by Eat My Pixel, a payment processor or the provider. Providing technical payment facilities does not, by itself, make Eat My Pixel the supplier of the booked service.
Requests to cancel, reschedule or obtain a refund for a provider service must normally be directed to the provider. Eat My Pixel may help pass on communications but does not control the provider’s final decision.
The provider must administer its policy fairly and in accordance with applicable consumer law. Nothing in these Terms removes any statutory right you may have against the provider.
Listings, photographs and reviews
Providers are responsible for ensuring information they supply for their listing is accurate, current and not misleading. Eat My Pixel may edit information for clarity, formatting or presentation.
Although reasonable care may be taken when preparing listings, information such as prices, availability, personnel and services can change. You should confirm important information with the provider before booking.
Photographs may be supplied by providers or used for illustrative purposes.
Any review submitted must reflect a genuine experience and must not be false, abusive, discriminatory, defamatory, incentivised without disclosure or submitted in order to manipulate ratings.
Eat My Pixel may refuse, investigate or remove content that appears unlawful, fraudulent, misleading or contrary to these Terms.
Responsibility and liability
Eat My Pixel will provide its own creative services with reasonable care and skill. Nothing in these Terms excludes liability where it would be unlawful to do so.
In particular, nothing excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of rights that cannot legally be excluded;
- any other liability that the law does not permit us to exclude.
Eat My Pixel is not responsible for a third-party provider’s acts, omissions, professional advice, treatment, products, premises, employees, contractors or delivery of a service, except to the extent that Eat My Pixel is legally responsible.
We do not guarantee that every provider will always be available, suitable for every customer or free from error.
Eat My Pixel is not responsible for losses caused by:
- inaccurate information supplied by a client, visitor or provider;
- third-party websites, platforms, hosting, software or payment systems;
- events outside reasonable control;
- a visitor failing to follow reasonable instructions or provider requirements.
If you are acting in the course of a business, Eat My Pixel will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings or loss of business opportunity, except where liability cannot lawfully be excluded.
Consumers retain all rights and remedies provided by law.
Privacy and cookies
Eat My Pixel processes personal information in accordance with its Privacy Policy and applicable UK data protection law.
If you submit an enquiry or booking request concerning an independent Hub provider, relevant information may be shared with that provider so it can respond to or administer your request.
Once the provider receives your information, it may act as a separate data controller and should explain how it processes your information.
Complaints
For a complaint about a service supplied directly by Eat My Pixel, email hello@eatmypixel.co.uk with your name, relevant project or invoice details and a clear explanation of the issue.
We will acknowledge and investigate complaints within a reasonable time.
For a complaint about an independent Business Hub provider, contact that provider first. The provider is responsible for investigating complaints about its service.
You may notify Eat My Pixel of a serious concern about a listed provider. We may review the listing, request information or remove access to the Hub, but this does not make Eat My Pixel responsible for resolving the underlying service dispute.
General terms
Changes to these Terms
We may update these Terms to reflect changes to the website, services, Business Hub or applicable law. The latest version will be published on this page with its revision date.
Events outside our control
Eat My Pixel will not be responsible for delay or failure caused by events outside reasonable control, including serious illness, power or internet failure, platform outages, extreme weather, industrial action or government action.
Severability
If a court finds part of these Terms unlawful or unenforceable, the remaining sections will continue to apply.
No waiver
A delay in enforcing a right does not mean that right has been given up.
Third-party rights
Unless expressly stated otherwise, a person who is not a party to an agreement under these Terms has no right to enforce it.
Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have rights to bring proceedings in the part of the United Kingdom where you live. Business disputes will be subject to the jurisdiction of the courts of England and Wales.
